Allgemeine Liefer- und Geschaeftsbedingungen (AGB) 

  1. Allgemeines 

1. Die nachfolgenden allgemeinen Liefer- und Geschaeftsbedingungen (im 

folgenden AGB genannt) gelten fuer alle von Sascha Rheker (im nachfolgenden Sascha Rheker oder Fotograf genannt) durchgefuehrten Auftraege, Angebote, Lieferungen und Leistungen. 

2. Sie gelten als vereinbart mit Entgegennahme der Lieferung oder Leistung 

bzw. des Angebots von Sascha Rheker durch den Kunden, 

spaetestens jedoch mit der Annahme des Bildmaterials zur Veröffentlichung. 

3. Wenn der Kunde den AGB widersprechen will, ist dieses schriftlich binnen 

drei Werktagen zu erklaeren. Abweichenden Geschaeftsbedingungen des 

Kunden wird hiermit widersprochen. Abweichende Geschaeftsbedingungen 

des Kunden erlangen keine Gueltigkeit, es sei denn, dass Sascha Rheker diese schriftlich anerkennen. 

4. Die AGB gelten im Rahmen einer laufenden Geschaeftsbeziehung auch 

ohne ausdrueckliche Einbeziehung auch fuer alle zukuenftigen Auftraege, 

Angebote, Lieferungen und Leistungen von Sascha Rheker. 

  1. Ueberlassenes Bildmaterial 

1. Die AGB gelten fuer jegliches dem Kunden ueberlassenes Bildmaterial, 

gleich in welcher Schaffensstufe oder in welcher technischen Form es 

vorliegt. Sie gelten insbesondere auch fuer elektronisches oder digital 

uebermitteltes Bildmaterial. 

2. Der Kunde erkennt an, dass es sich bei dem von Sascha Rheker 

gelieferten Bildmaterial um Lichtbildwerke im Sinne von § 2 Abs.1 Ziff. 5 

UrhRG handelt. 

3. Vom Kunden in Auftrag gegebene Gestaltungsvorschlaege oder 

Konzeptionen sind eigenstaendige Leistungen, die zu vergueten sind. 

4. Das ueberlassene Bildmaterial bleibt Eigentum des Sascha Rheker, 

und zwar auch in dem Fall, dass Schadensersatz hierfuer geleistet wird.

5. Der Kunde hat das Bildmaterial sorgfaeltig und pfleglich zu behandeln und 

darf es an Dritte nur zu geschaeftsinternen Zwecken der Sichtung, Auswahl 

und technischen Verarbeitung weitergeben. 

6. Reklamationen, die den Inhalt der gelieferten Sendung oder Inhalt, 

Qualitaet oder Zustand des Bildmaterials betreffen, sind innerhalb von 48 

Stunden nach Empfang mitzuteilen. Anderenfalls gilt das Bildmaterial als 

ordnungsgemaess, vertragsgemaess und wie verzeichnet zugegangen. 

III. Nutzungsrechte 

1. Der Kunde erwirbt grundsaetzlich nur ein einfaches Nutzungsrecht zur 

einmaligen Verwendung. 

2. Ausschliessliche Nutzungsrechte, medienbezogene oder raeumliche 

Exclusivrechte oder Sperrfristen muessen gesondert vereinbart werden und 

bedingen einen Aufschlag von mindestens 100% auf das jeweilige 

Grundhonorar. 

3. Mit der Lieferung wird lediglich das Nutzungsrecht fuer die einmalige 

Nutzung des Bildmaterials zu dem vom Kunden angegebenen Zweck und in 

der Publikation und in dem Medium oder Datentraeger, welche/-s/-n der 

Kunde angegeben hat oder welche/-s/-r sich aus den Umstaenden der 

Auftragserteilung ergibt, uebertragen . Im Zweifelsfall ist massgeblich das 

Objekt (Zeitung, Zeitschrift usw.), fuer das das Bildmaterial ausweislich des 

Lieferscheins, der Kundenregistrierung im Archivsystem oder der Versandadresse zur Verfuegung gestellt worden ist. 

4. Jede ueber Ziffer 3. hinausgehende Nutzung, Verwertung, 

Vervielfaeltigung, Verbreitung oder Veröffentlichung ist honorarpflichtig und 

bedarf der vorherigen ausdruecklichen Zustimmung. 

Das gilt insbesondere fuer: 

– eine Zweitverwertung oder Zweitveröffentlichung, insbesondere in 

Sammelbaenden, produktbegleitenden Prospekten, bei Werbemassnahmen 

oder bei sonstigen Nachdrucken, 

  • jegliche Bearbeitung, Aenderung oder Umgestaltung des Bildmaterials 

– die Digitalisierung, Speicherung oder Duplizierung des Bildmaterials auf 

Datentraegern aller Art (z.B. magnetische, optische, magnetooptische oder 

elektronische Traegermedien wie CD-ROM, CDi, Disketten, Festplatten, 

Arbeitsspeicher, Mikrofilm etc.), soweit dieses nicht nur der technischen 

Verarbeitung des Bildmaterials gem. Ziff. III 3. AGB dient,

– jegliche Vervielfaeltigung oder Nutzung der Bilddaten auf CD-ROM, CDi, 

Disketten oder aehnlichen Datentraegern, 

– jegliche Aufnahme oder Wiedergabe der Bilddaten im Internet/WWW oder in 

Online- Datenbanken oder in anderen elektronischen Archiven (auch soweit 

es sich um interne elektronische Archive des Kunden handelt), 

– die Weitergabe des digitalisierten Bildmaterials im Wege der 

Datenfernuebertragung oder auf Datentraegern, die zur öffentlichen 

Wiedergabe auf Bildschirmen oder zur Herstellung von Hardcopies geeignet 

sind. 

5. Veraenderungen des Bildmaterials durch Foto-Composing, 

Montage/Collage oder durch elektronische Hilfsmittel zur Erstellung eines 

neuen urheberrechtlich geschuetzten Werkes sind nur nach vorheriger 

schriftlicher Zustimmung von Sascha Rheker und nur bei 

Kennzeichnung mit [M] gestattet. Auch darf das Bildmaterial nicht 

abgezeichnet, abgefilmt, nachgestellt fotografiert oder anderweitig als Motiv 

benutzt werden. 

6. Der Kunde ist nicht berechtigt, die ihm eingeraeumten Nutzungsrechte 

ganz oder teilweise auf Dritte, auch nicht auf andere Konzern- oder 

Tochterunternehmen, zu uebertragen. 

7. Jegliche Nutzung, Wiedergabe oder Weitergabe des Bildmaterials ist nur 

gestattet unter der Voraussetzung der Anbringung des vorgegebenen Urhebervermerks („Sascha Rheker / www.sascharheker.com“, mindestens jedoch „Sascha Rheker“) 

8. Der Kunde verpflichtet sich, bei der Verwendung der Aufnahmen 

Allgemeine Persönlichkeitsrechte und das Recht am eigenen Bild abgebildeter 

Personen nicht zu verletzen. Der Kunde ist ggf. zur Einholung erforderlicher 

Einwilligungen verpflichtet und haftet fuer Schadensersatzansprueche, die in 

diesem Zusammenhang entstehen. Es gilt als vereinbart, dass die Sascha Rheker grundsaetzlich nur Bildmaterial ohne 

Einverstaendniserklaerungen/Model Release der abgebildeten Personen zur 

Verfuegung stellt. 

IV. Honorare 

1. Es gilt das vereinbarte Honorar. Ist kein Honorar vereinbart worden, 

bestimmt es sich nach der jeweils aktuellen Bildhonoraruebersicht der 

Mittelstandsgemeinschaft Foto-Marketing (MFM). Es gilt ein Mindesthonorar von 50,- €. Das Honorar versteht sich zuzueglich der jeweils gueltigen Mehrwertsteuer. 

2. Das Honorar gilt nur fuer die einmalige Nutzung des Bildmaterials zu dem 

vereinbarten Zweck gemaess Ziff.III 3. oder 2. AGB. Soll das Honorar auch 

fuer eine weitergehende Nutzung bestimmt sein, ist dieses schriftlich zu 

vereinbaren. 

3. Durch den Auftrag anfallende Kosten und Auslagen (z.B. Material-und 

Laborkosten, Modellhonorare, Kosten fuer erforderliche Requisiten, 

Reisekosten, erforderliche Spesen etc.) sind nicht im Honorar enthalten und 

gehen zu Lasten des Kunden. 

4. Das Honorar gemaess IV. 1. AGB ist auch dann in voller Höhe zu zahlen, 

wenn das in Auftrag gegebene und gelieferte Bildmaterial nicht veröffentlicht 

wird. Bei Verwendung der Aufnahmen als Arbeitsvorlage fuer Layout- und 

Praesentationszwecke faellt vorbehaltlich einer abweichenden Vereinbarung 

ein Honorar von mindestens 100,00 Euro pro Aufnahme an. 

5. Das Honorar ist spaetestens binnen 2 Wochen nach Rechnungsstellung zu 

zahlen, soweit in der Rechnung keine kuerzere Zahlungsfrist angegeben ist. 

Nach einer Mahnung kommt der Kunde in Verzug. Nach Eintritt des Verzugs 

ist das Honorar mit 10% p.a. zu verzinsen. Eine Aufrechnung oder die 

Ausuebung des Zurueckbehaltungsrechts ist nur gegenueber unbestrittenen 

oder rechtskraeftig festgestellten Forderungen des Kunden zulaessig. 

V. Rueckgabe des Bildmaterials 

1. Das Bildmaterial ist, es sei denn es handelt sich um digitale Bilddaten, in der gelieferten Form unverzueglich nach der  Veröffentlichung oder der vereinbarten Nutzung, spaetestens jedoch 1 Monat  nach dem Lieferdatum, unaufgefordert zurueckzusenden. Beizufuegen sind  zwei Belegexemplare. Eine Verlaengerung der 1-Monatsfrist bedarf der schriftlichen Genehmigung des Fotografen. 

2. Ueberlaesst der Fotograf auf Anforderung des Kunden oder mit 

dessen Einverstaendnis Bildmaterial lediglich zum Zwecke der Pruefung, ob 

eine Nutzung oder Veröffentlichung in Betracht kommt, hat der Kunde das 

Bildmaterial spaetestens innerhalb eines Monats nach Erhalt 

zurueckzugeben, sofern auf dem Lieferschein keine andere Frist vermerkt ist. 

Eine Verlaengerung dieser Frist ist nur wirksam, wenn sie vom 

Fotografen schriftlich bestaetigt worden ist. 

3. Die Ruecksendung des Bildmaterials erfolgt durch den Kunden auf dessen 

Kosten in branchenueblicher Verpackung. Der Kunde traegt das Risiko des

Verlusts oder der Beschaedigung waehrend des Transports bis zum Eingang 

beim Fotografen.

 

VI. Vertragsstrafe, Blockierung, Schadensersatz 

1. Bei jeglicher unberechtigten (ohne Zustimmung des Fotografen 

erfolgten) Nutzung, Verwendung, Wiedergabe oder Weitergabe des 

Bildmaterials ist fuer jeden Einzelfall eine Vertragsstrafe in Höhe des 

fuenffachen Nutzungshonorars zu zahlen, vorbehaltlich weitergehender 

Schadensersatzansprueche. 

2. Bei unterlassenem, unvollstaendigem, falsch plaziertem oder nicht 

zuordnungsfaehigem Urhebervermerk ist ein Aufschlag in Höhe von 100% 

des Nutzungshonorars zu zahlen. 

3. Bei nicht rechtzeitiger Rueckgabe des Bildmaterials (Blockierung) ist fuer 

die Zeit nach Ablauf der in Ziff.V.1.oder 2. gesetzten Fristen eine 

Vertragsstrafe zu zahlen in Höhe von 

– Euro 1,00 pro Tag und Bild fuer s/w- oder Color-Abzuege oder Dia- 

Duplikate 

– Euro 2,00 pro Tag und Bild fuer Dias, Negative oder andere Unikate. 

4. Fuer beschaedigtes, zerstörtes oder abhandengekommenes Bildmaterial 

ist Schadensersatz zu leisten, ohne dass der Fotograf die Höhe 

des Schadens nachzuweisen hat in Höhe von 

– Euro 40,00 pro s/w- oder Colorabzug oder KB-Dia-Duplikat 

– Euro 125,00 pro Mittel- oder Grossformat-Dia-Duplikat 

– Euro 750,00 pro Dia-Original, Negativ oder anderem Unikat 

– Euro 1.500,00 pro nicht wiederholbarem Dia, Negativ oder anderem Unikat. 

Bei Beschaedigungen sind die Saetze entsprechend dem Grad der 

Beschaedigung und dem Umfang der weiteren Nutzungsmöglichkeit

herabzusetzen. Grundsaetzlich bleibt beiden Vertragsparteien der Nachweis 

vorbehalten, dass ein höherer bzw. geringerer Schaden eingetreten ist. 

5. Bei fehlendem Belegexemplar oder bei Abrechnung ohne Belegexemplar 

oder bei Abrechnung ohne Angabe, welches Bild an welcher Stelle in welcher 

Publikation verwendet worden ist, ist eine Vertragsstrafe in Höhe von 50% 

des Nutzungshonorars zu zahlen. 

6. Durch diese Zahlungen gemaess Ziffer VI. werden keinerlei 

Nutzungsrechte begruendet. 

VII. Rechtliche Bestimmungen 

1. Es gilt das Recht der Bundesrepublik Deutschland als vereinbart, und zwar 

auch bei Lieferungen ins Ausland. 

2. Nebenabreden zum Vertrag oder zu diesen AGB beduerfen zu ihrer 

Wirksamkeit der Schriftform. 

3. Die etwaige Nichtigkeit bzw. Unwirksamkeit einer oder mehrerer 

Bestimmungen dieser AGB beruehrt nicht die Wirksamkeit der uebrigen 

Bestimmungen. Die Parteien verpflichten sich, die ungueltige Bestimmung 

durch eine sinnentsprechende wirksame Bestimmung zu ersetzen, die der 

angestrebten Regelung wirtschaftlich und juristisch am naechsten kommt. 

4. Erfuellungsort und Gerichtsstand ist der Wohnort des Fotografen.

General Terms of Business 

I. General 

1. The subsequent General Terms and Conditions of Business shall apply to 

all orders, quotations and supplies and services implemented by Sascha Rheker.

In the following conditions of contract “the photographer(s)” shall mean Sascha Rheker. 

2. They are deemed to have been agreed following the customer’s receipt of 

user’s supplies/services or quotation, in any case following acceptance of the 

photographic material for publication at the latest. 

3. In the event that the customer intends to object to the General Terms and 

Conditions of Business, he shall declare so in writing within three working 

days. An objection is hereby made to diverging Terms and Conditions of 

Business stipulated by the customer. Diverging Terms and Conditions of 

Business stipulated by the customer shall not be valid unless approved in 

writing by the photographer. 

4. Within the framework of an ongoing business relationship the General 

Terms and Conditions of Business shall also apply to all future orders, 

quotations and supplies and services, without having to include them 

specifically. 

II. Photographic material surrendered for use 

1. The General Terms and Conditions of Business apply to all photographic 

material provided to the customer, irrespective of its completion stage or 

available technical format. The conditions shall apply especially to electronic 

or digitally transmitted photographic material. 

2. The customer accepts that the photographic material supplied by 

the photographer consists of photographs in accordance with § II, Section 1, 

Clause 5 of the Copyright Act or § 2 Abs.1 Ziff. 5 UrhRG. 

3. Design proposals or concepts commissioned by the customer are 

independent services which must be remunerated separately.

4. The surrendered photographic material remains the photographers property; the aforesaid shall also apply in the case of compensation payments. 

5. The customer shall treat the photographic material with due care and may 

only pass it on to third parties for internal business purposes, i.e. inspection, 

selection and technical processing. 

6. Complaints relating to the content of the supplied items or the content, 

quality or state of the photographic material, must be communicated within 

48 hours of receipt. The photographic material is otherwise deemed to have 

been delivered appropriately, in accordance with the contract and as noted. 

III. Rights of utilisation 

1. In principle, the customer only acquires a non-exclusive license for single 

usage. 

2. Exclusive rights of utilisation, media-related or territorial exclusive rights 

or blocking periods must be agreed separately and are subject to a minimum 

surcharge of 100% on the relevant basic fee. 

3. The delivery only constitutes the transferral of the right of utilisation for 

the single usage of the photographic material for the purpose specified by 

the customer and in the publication, medium or data carrier which has been 

specified by the customer or which results from the relevant circumstances 

under which the order has been placed. If in doubt, the relevant object 

(newspaper, magazine etc.) for which the photographic material has been 

provided in accordance with the delivery docket, archive registration or the dispatch address, shall be decisive. 

4. Any use, utilisation, duplication, dissemination or publication beyond the 

stipulations contained in Clause 3 is subject to payment and requires prior 

explicit approval by the photographer. 

In particular, this shall apply to:

– any editing, changing or redesigning of the photographic material, 

– secondary utilisation or publication, especially in anthologies, product- 

related brochures, advertising campaigns or other reprints,

– the digitalisation, storage or duplication of the photographic material on 

any type of data carrier (e.g. magnetic, optic, magneto-optic or electronic 

carrier media such as CD ROM, CDi, diskettes, hard drives, RAM, microfilm 

etc.) unless such transactions are only performed for the technical processing 

of the photographic material in accordance with Clause III, 3 of the General 

Terms and Conditions of Business, 

– any duplication or utilisation of the picture data on CD ROM, CDi, diskettes 

or similar data carriers, 

– any recording or reproduction of picture data on the Internet or in online 

databases or in other electronic archives (this even applies to the customer’s 

internal electronic archives), 

– the disclosure of digitalised photographic material within the scope of 

remote data transmission or on data carriers which are suitable for public 

reproduction on screens or for the creation of hard copies. 

5. Changes to the photographic material implemented by photo-composing 

or photomontage or with electronic aids for the creation of a new 

copyrighted item are only permitted without prior approval in writing by the 

photographer and only if such material is marked with [M]. Nor 

may the photographic material be drawn, copied, photographed or otherwise 

used as a motive. 

6. The customer is not authorised to transfer the rights of utilisation granted 

to him to third parties including other group companies or subsidiaries, 

either in whole or in part. 

7. Any utilisation, reproduction or transfer of the photographic material shall 

only be permitted with the proviso that the photographers 

copyright notice has been attached. 

8. When using the photos, the client is obliged to observe the general rights 

of the individual and the right of the depicted person, and to not act contrary 

to these rights. The client is obliged to obtain any necessary permits and is 

liable for claims for damages arising from this. The photographer generally delivers photographs without a permission/model  release of the depicted person/persons. 

IV. Fees 

1. The agreed fee shall apply. In the event that no fee has been agreed, the 

relevant work is governed by the current photograph fee guideline issued by

the Mittelstandsgemeinschaft Foto-Marketing (small business association for 

photo marketing). The minimum fee per picture is 50,- €. The fee is subject to VAT at the statutory rate. 

2. The fee shall only be valid for the non-recurrent use of the photographic 

material for the agreed purpose, in accordance with Clause III, 3 or 2 of the 

General Terms and Conditions of Business. In the event that the fee is also to 

include further use, this must be agreed separately. 

3. Any costs and expenditure incurred by the order (e.g. material and 

laboratory costs, model fees, costs for required props, travel expenses, per 

diems etc.) are not included in the fee and shall be at the customer’s 

expense. 

4. The fee in accordance with IV. 1 of the General Terms and Conditions of 

Business shall also be settled in full if the commissioned and supplied 

photographic material is not published. If the photographs are used as a 

working model for layout and presentation purposes, a minimum fee of Euro 

100 per photograph shall be payable, except as otherwise agreed. 

5. The fee shall be paid within 2 weeks of the invoice date at the latest, 

unless a shorter payment period is stipulated in the invoice. Following a 

reminder, the customer is deemed to be in default. When default occurs, 

interest of 10% p.a. shall be payable on this fee. Setoff of costs or the 

exercise of the retention right shall only be permitted in the event that the 

relevant claims brought forward by the customer are undisputed and 

recognised by declaratory judgement. 

V. Return of the photographic material 

1. The photographic material must be returned in the form in which it was 

originally supplied, without being asked to do so, immediately upon 

publication or the agreed use, in any case within three months of the delivery 

date at the latest. Two proofs must be attached. An extension of the three- 

month period requires the photographers written approval. 

2. In the event that the photographer surrenders photographic 

material to the customer for test purposes only, at the customer’s request or 

with his approval, in order to determine whether utilisation or publication is 

desirable, the customer shall return the photographic material within one 

month of receipt at the latest, unless a different period is stipulated in the 

delivery docket. This period may only be extended if confirmed by the 

photographer in writing.

3. The photographic material shall be returned at the customer’s expense 

and with the customary packaging. The customer shall bear the risk of loss 

or damage during transport until such time as the package has been received 

by the photographer. 

VI. Contractual penalties, blocking, compensation 

1. Each incident of unauthorised use, utilisation, reproduction or transfer of 

the photographic material (without photographers approval) is 

subject to a contractual penalty of five times the usage fee, subject to further 

claims for damages. 

2. In the event that the copyright notice is not included, incomplete, 

incorrectly placed or non-allocable, a surcharge of 100% of the utilisation fee 

shall be paid. 

3. In the event that the photographic material is not returned in good time 

(blocking), the period after the expiry of the periods specified in Clause V.1 

or 2, is subject to a contractual penalty amounting to 

– Euro 1,00 per day and picture for black & white or colour prints or slide 

duplicates 

– Euro 2,00 per day and picture for slides, negatives or other unique copies 

4. Damaged, destroyed or lost photographic material is subject to 

compensation without the photographer having to furnish 

evidence of the amount of damage incurred, where such damage amounts to: 

– Euro 40,00 per black & white or colour print or slide duplicate 

– Euro 125,00 per medium or large format slide duplicate 

– Euro 750,00 per slide original, negative or other unique copy 

– Euro 1500,00 per non-reproducible slide, negative or other unique copy.

In the case of damage, the above rates must be reduced in accordance with 

the relevant extent of damage and the scope of remaining utilisation options. 

In principle, both contracting parties reserve the right to furnish proof of 

more/less damage. 

5. In the absence of a proof or when billing is implemented without a proof 

or when billing is implemented without specifying which picture has been 

used where and in which publication, a contractual penalty of 50% of the 

usage fee is to be paid. 

6. The payments in accordance with Clause VI do not substantiate any rights 

of use. 

VII. Legal agreements 

1. These conditions are governed by German law, also in the event that 

deliveries are effected abroad. 

2. Ancillary agreements to this contract or to these General Terms and 

Conditions of Business must be implemented in writing in order to be 

effective. 

3. In the event that one or several stipulations of these General Terms and 

Conditions of Business are void or ineffective, the validity of the remaining 

stipulations shall not be affected. The parties are obliged to replace the 

invalid stipulation with an analogous, effective regulation that corresponds as 

far as possible to the intended regulation in terms of its economic and legal 

effect. 

4. The place of performance and court venue shall be the residential city of 

the photographer.
